Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Campus Hearts governing your access to and use of the Campus Hearts app. They should be read alongside our Community Guidelines, Privacy & Anonymity Policy, and Disclaimer, which are incorporated into these Terms by reference. By creating an account, you agree to all four.
1. Agreement to Terms
By tapping "I Agree," creating an account, or otherwise using Campus Hearts, you confirm that you have read, understood, and agree to be bound by these Terms, our Community Guidelines, our Privacy & Anonymity Policy, and our Disclaimer. If you do not agree, do not create an account or use the app.
We may update these Terms as Campus Hearts grows. If we make material changes, we will notify you in the app or by email before they take effect. Continuing to use Campus Hearts after changes take effect means you accept the updated Terms.
2. Eligibility
Campus Hearts is intended for current college students who are at least 18 years old and able to verify enrollment with a school email address. By using Campus Hearts, you represent that you meet these requirements. We may suspend or terminate accounts that do not.
While we use a school email address to verify current student status, we cannot guarantee that every account on Campus Hearts belongs to a currently enrolled student — for example, we cannot always detect a recent graduate who retains access to their school email, or someone who has misrepresented their status. If we learn that an account does not meet our eligibility requirements, we may suspend or remove it.
You also represent that you are not located in, or a resident of, any country or region subject to U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must provide accurate information when creating your account, including a valid school email address used solely to verify current student status.
- You may not create more than one account, impersonate another person, or use another student's credentials.
- Notify us immediately if you believe your account has been accessed without your permission.
4. License to Use the App
Subject to your compliance with these Terms, Campus Hearts grants you a limited, non-exclusive, non-transferable, revocable license to access and use the app on devices you own or control, for your personal, non-commercial use. This license does not give you any ownership interest in Campus Hearts, its app, brand, or underlying technology. You may not copy, modify, reverse-engineer, resell, sublicense, or distribute the app, or use it to build a competing product.
5. Your Content and the License You Grant Us
You retain ownership of the posts, comments, reactions, DMs, mood calendar entries, and resource library submissions you create ("Your Content"). We do not claim ownership of Your Content.
By posting Your Content on Campus Hearts, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute Your Content solely as necessary to operate, moderate, and improve the app — for example, showing your post to your campus community, or reviewing flagged content for a Community Guidelines violation. This license ends when you delete Your Content or your account, except where a copy is retained for a limited period as described in our Privacy & Anonymity Policy (for example, to address a safety concern or legal obligation), or where Your Content has already been seen, saved, or shared by other students in its already-anonymous form.
You represent and warrant that Your Content: is true to your own experience and not knowingly false or misleading; does not infringe any third party's copyright, trademark, privacy, or other rights; does not violate any law; is not defamatory or unlawfully threatening or harassing; and does not misrepresent you as being employed by, affiliated with, or acting on behalf of Campus Hearts.
6. Community Standards
Campus Hearts has zero tolerance for objectionable content or abusive conduct. By using the app, you agree to follow our Community Guidelines, which prohibit (among other things) harassment and personal attacks, hate speech, misinformation and impersonation, spam, illegal activity, content that encourages self-harm, obscene content, threats of violence, and non-consensual sharing of a revealed identity or off-platform screenshots. Our Community Guidelines are incorporated into these Terms, and a violation of the Community Guidelines is a violation of these Terms.
7. Prohibited Conduct
In addition to following our Community Guidelines, you agree not to:
- Use bots, scrapers, crawlers, or other automated means to access or collect data from Campus Hearts.
- Attempt to phish, pharm, or otherwise deceive another student into sharing personal or account information.
- Attempt to access another student's account, or any part of Campus Hearts's systems, without authorization.
- Interfere with or disrupt the security, integrity, or performance of the app.
- Upload viruses, malware, or other harmful code.
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except as permitted by law.
- Use Campus Hearts for any journalistic, investigative, research, or commercial purpose without first disclosing that purpose to us in writing.
8. Reporting, Moderation & Enforcement
- Every post, comment, and DM can be flagged for review using the in-app report function.
- You can block another student at any time to stop further contact from them.
- We review reports of objectionable content and act on them promptly, which may include removing content, disabling features on an account, or suspending or terminating the account responsible.
- We may take these actions at our discretion, with or without prior notice, when we reasonably believe these Terms or our Community Guidelines have been violated.
If a report or post suggests an imminent, credible risk to someone's safety, we may share available information with local emergency services (911) or your school, as described in our Privacy & Anonymity Policy.
9. Direct Messages & Identity-Reveal
Campus Hearts lets you message other students anonymously when they allow DMs on a post, and to choose whether to reveal your identity within that conversation. Identity-reveal is your choice, applies only to that conversation, and does not give either party any right to share the other's revealed identity with anyone else. Any in-person meeting arranged through a DM is at your own discretion and risk, as described in our Disclaimer.
10. Third-Party Links
The resource library and other parts of Campus Hearts may include links to third-party websites or materials that students find helpful. These links are provided for reference only and do not mean we endorse, vet, or are affiliated with the linked site or its content. We are not responsible for the availability, accuracy, or content of any third-party site, and you access any linked site at your own risk and subject to that site's own terms and privacy practices.
11. Term, Suspension & Termination
- You may stop using Campus Hearts and delete your account at any time.
- We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms or our Community Guidelines, misused the app, or created risk or legal exposure for us or another student.
- On termination, your license to use the app ends immediately. Content you posted may remain visible to the community in its already-anonymous form, consistent with our Privacy & Anonymity Policy and Data Retention practices.
- Once your account is terminated or deleted, your data generally cannot be recovered.
- If we terminate your account for violating these Terms or our Community Guidelines, you may not create a new account under your own name, a different name, or on behalf of someone else.
- Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
12. Disclaimers
Campus Hearts is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, secure, or error-free, or that content posted by other students is accurate, appropriate, or safe.
As explained in our Disclaimer, content on Campus Hearts reflects the personal views of individual students, is not professional medical, mental health, legal, or relationship advice, and Campus Hearts is not affiliated with, endorsed by, or operated by any university.
13. Limitation of Liability
To the fullest extent permitted by law, Campus Hearts, its founders, and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or related to your use of the app, the conduct of other users (online or in person), or content posted by others — even if we have been advised of the possibility of such damages. To the extent any liability cannot be excluded under applicable law, our total liability to you for any claim arising from your use of Campus Hearts will not exceed the greater of $100 or the amount you paid us, if any, in the twelve months before the claim arose.
14. Indemnification
You agree to indemnify and hold harmless Campus Hearts, its founders, and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your violation of these Terms or our Community Guidelines, or your interactions with other students, including any in-person meeting arranged through the app.
15. Dispute Resolution & Arbitration Agreement
Most concerns can be resolved by contacting us first, and we encourage you to do that before pursuing a formal claim. For any dispute that cannot be resolved informally, you and Campus Hearts agree to resolve it through binding, individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. This means you and Campus Hearts each waive the right to a jury trial and to participate in a class action, class arbitration, or representative action. Arbitration will be conducted by a recognized arbitration provider under its consumer arbitration rules then in effect.
This arbitration agreement does not apply to any claim in which either party seeks injunctive or other equitable relief for infringement or misuse of intellectual property. You may opt out of this arbitration agreement by notifying us in writing within 30 days of first accepting these Terms.
16. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Subject to Section 15, any action not subject to arbitration will be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction there.
17. Apple App Store Terms
If you downloaded Campus Hearts from the Apple App Store, the following additional terms apply:
- This agreement is between you and Campus Hearts only, not Apple, and Campus Hearts — not Apple — is solely responsible for the app and its content.
- Your license to use the app is limited to a non-transferable license to use it on Apple-branded devices that you own or control, as permitted by Apple's Usage Rules.
- Apple has no obligation to provide maintenance or support for the app.
- In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims relating to the app, including product liability claims, legal or regulatory compliance claims, or consumer protection claims.
- Apple is not responsible for investigating, defending, or resolving any third-party intellectual property infringement claim related to the app.
- You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
- You must comply with any applicable third-party agreements (such as your wireless carrier's data terms) when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary.
18. General Provisions
- Entire Agreement: These Terms, together with our Community Guidelines, Privacy & Anonymity Policy, and Disclaimer, are the complete agreement between you and Campus Hearts about your use of the app, and replace any earlier agreements or understandings on that subject.
- Severability: If any part of these Terms is found unenforceable, the rest of these Terms will remain in full effect, and the unenforceable part will be limited or removed only to the extent necessary.
- No Waiver: If we do not act on a violation of these Terms right away, that does not mean we are giving up our right to act on it, or on similar violations, later.
- Assignment: You may not transfer your rights or obligations under these Terms to anyone else. We may transfer these Terms — for example, if Campus Hearts is acquired or reorganized — and these Terms will continue to apply to your use of the app under the new owner.
19. Changes to These Terms
As Campus Hearts grows, we may update these Terms to reflect new features or practices. We'll post the updated version here with a new "Last updated" date, and where changes are material, we will notify you in the app or by email before they take effect.
